Terms of Service

These Terms of Service govern your access to and use of AppraisalAPI and related services. By accessing or using the Service, including by uploading a file, submitting content through the website or API, requesting or downloading Output, or clicking to accept these Terms, you agree to be bound by these Terms.

If you do not agree, do not use the Service.

1. Definitions

"AppraisalAPI," "we," "us," or "our" means AppraisalAPI, located in Texas, USA.

"Service" means AppraisalAPI's website, extraction tools, result pages, downloads, APIs, developer tools, documentation, emails, and related services.

"Submission" means any file, document, appraisal, PDF, text, data, prompt, API request, metadata, or other content submitted to the Service.

"Output" means any extracted fields, structured data, CSV, XLSX, JSON, summaries, or other results generated or returned by the Service.

2. Eligibility and Authority

You represent and warrant that:

  • you are at least 18 years old;
  • you have the legal capacity to enter into these Terms; and
  • if you use the Service on behalf of a company or other entity, you have authority to bind that entity to these Terms.

3. Description of the Service

The Service is a free, automated, AI-assisted convenience tool that extracts information from appraisals and related documents and returns structured Output. The Service is experimental in nature and may contain bugs, inaccuracies, omissions, inconsistencies, delays, or other errors.

The Service is provided solely for convenience and preliminary workflow support. It is not a substitute for professional appraisal review, underwriting review, legal review, compliance review, or any human verification process.

The Service references and implements third-party data standards, including the BRAVE standard, as part of its extraction functionality. AppraisalAPI does not control, maintain, or endorse any third-party data standard and is not responsible for changes to such standards. We do not guarantee continued compatibility with any version of any third-party standard.

We may modify, suspend, limit, or discontinue any part of the Service at any time, with or without notice.

4. User Responsibilities; Rights to Submit

You are solely responsible for your Submissions and your use of the Service.

You represent and warrant that:

  • you own or control all rights, permissions, and authority necessary to submit each Submission and to authorize us and our service providers to process, store, analyze, transmit, and use the Submission and resulting Output as described in these Terms and the Privacy Policy;
  • your Submission, and our processing of it as authorized by you, will not violate any law, regulation, contract, subscription agreement, license restriction, website terms, confidentiality obligation, privacy obligation, court order, or third-party right;
  • you have obtained all required notices, consents, and permissions relating to your Submission; and
  • you will not submit material that you are prohibited from disclosing or processing.

You may not upload any document or material if your submission or our processing of it would violate any third-party contract, subscription agreement, website terms, confidentiality duty, or intellectual property right.

5. License to Process; Use of Outputs and Service Data

You grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, process, reproduce, transmit, analyze, display, and otherwise use Submissions and Output as necessary to provide, maintain, secure, debug, improve, benchmark, and develop the Service.

You further agree that we may retain and use:

  • Output;
  • document fingerprints, hashes, metadata, and logs;
  • usage data and technical information;
  • de-identified, aggregated, statistical, and derived data created from Submissions, Output, and use of the Service

for internal analytics, quality assurance, benchmarking, research, training, abuse prevention, product improvement, and commercial business purposes, provided that such use does not identify you as the source of a particular Submission except as necessary to operate the Service, comply with law, protect our rights, or enforce these Terms.

6. Third-Party Services and AI Processing

To operate the Service, we may use third-party service providers, including providers of hosting, storage, email delivery, logging, analytics, OCR, parsing, document processing, and artificial intelligence or large language model services.

You acknowledge and agree that, in order to provide the Service, we may transmit, process, store, or analyze your Submission, portions of your Submission, Output, and related metadata using such third-party providers.

We are not responsible for the acts or omissions of third-party providers, except to the extent required by applicable law.

7. Email and Communications

You may be asked to provide an email address in order to receive Output, downloads, access links, service-related notices, support responses, or legal notices.

By providing your email address, you consent to receive such non-marketing, service-related communications from us.

We are not currently offering marketing or promotional emails through the Service unless you separately opt in.

8. Data Processing and Retention

We may store Submissions, Output, hashes, metadata, logs, and technical records in order to provide, secure, maintain, debug, improve, and enforce the Service.

We generally do not intentionally retain original uploaded PDF files after processing, except as needed for transient processing, security, abuse prevention, debugging, backup, legal compliance, caching, or incident response.

If the same or substantially similar Submission has been previously processed, we may return cached or previously generated Output.

9. API Terms

If we provide an API, the following additional terms apply:

  • API use is part of the Service and is subject to these Terms.
  • All content submitted through the API is a Submission, and all data returned by the API is Output.
  • You are responsible for all use of your API credentials and must keep them secure.
  • We may set and modify rate limits, quotas, technical restrictions, authentication requirements, and access rules at any time.
  • We may log, monitor, cache, store, and review API requests, responses, metadata, and usage for security, abuse prevention, debugging, analytics, deduplication, product improvement, and business operations.
  • You may not use the API to build a competing extraction service, bypass restrictions, probe for vulnerabilities, scrape the Service, or submit content you are not authorized to provide.
  • We may suspend or revoke API access at any time, with or without notice.
  • You may not use the API or Output in any production decisioning workflow unless you independently verify the Output through your own review controls.

10. Acceptable Use

You agree not to:

  • upload documents you do not have the right to process;
  • submit content in violation of any law, contract, subscription agreement, or confidentiality duty;
  • use the Service to infringe, misappropriate, or violate third-party rights;
  • upload malware, harmful code, or material intended to disrupt the Service;
  • reverse engineer, copy, scrape, probe, or abuse the Service;
  • bypass limits, security controls, or authentication;
  • use automated means to overload or interfere with the Service;
  • use the Service for unlawful, fraudulent, deceptive, or misleading purposes;
  • rely on the Service as a substitute for professional judgment, appraisal review, underwriting review, legal advice, compliance review, or regulatory analysis.

11. Accuracy; No Professional Advice; No Reliance

The Service uses automated and AI-assisted methods, including large language models and third-party processing tools, and may produce inaccurate, incomplete, inconsistent, misleading, outdated, or unsuitable Output.

The Service is provided for convenience only and does not constitute legal, appraisal, underwriting, lending, investment, compliance, accounting, regulatory, or other professional advice or review.

You are solely responsible for reviewing, validating, and independently verifying all Output before using it for any lending, underwriting, valuation, legal, regulatory, reporting, investment, compliance, servicing, or business purpose.

You may not rely on the Service as the sole basis for any decision, action, filing, representation, certification, underwriting conclusion, lending determination, valuation conclusion, or compliance position.

The Service attempts to extract data into fields defined by the BRAVE data standard. We do not guarantee that Output will conform to the BRAVE specification, pass third-party validation tools (including usebrave.org), or be accepted by any bank, lender, or other institution. You are responsible for validating all Output against the current BRAVE specification before submission to any third party.

You assume all risk arising from any use of the Service or Output.

The Service is intended for users capable of independently evaluating and verifying appraisal-related information and implementing appropriate internal review procedures.

12. No Confidentiality Obligation

Unless we expressly agree otherwise in a separately signed written agreement, Submissions made through the self-service Service are not provided to us under any fiduciary duty, advisory duty, appraisal-review duty, or special confidentiality obligation beyond the Privacy Policy.

12A. No Fiduciary Duty; No Special Relationship

Your use of the Service does not create any fiduciary, advisory, agency, partnership, joint venture, appraisal-review, underwriting-review, lender-review, professional-services, or other special relationship between you and AppraisalAPI.

We do not undertake any duty to monitor, validate, correct, or guarantee any Submission or Output.

13. Suspension, Removal, and Takedown

We may, in our sole discretion and without liability, reject, remove, disable, stop processing, withhold, or limit access to any Submission, Output, account, email, API key, or user at any time for legal risk, suspected infringement, abuse, security concerns, policy violations, excessive usage, or any other reason.

If you believe material submitted through the Service violates your rights, contact us at help@appraisalapi.com. We may remove or disable access while we review the matter.

14. Intellectual Property

We retain all rights, title, and interest in and to the Service, including all software, workflows, interfaces, documentation, branding, and related intellectual property, excluding your rights in your own Submissions as between you and us.

Except for the limited rights expressly granted in these Terms, no license or right is granted to you.

"BRAVE" and "Banking Real Estate Appraisal Valuation Exchange" are names associated with a third-party industry data standard. AppraisalAPI is not affiliated with, endorsed by, sponsored by, or officially connected with Valcre Inc., BRAVE Exchange, or any organization that maintains the BRAVE standard. All third-party trademarks, service marks, trade names, and product names referenced in the Service are the property of their respective owners. References to the BRAVE standard are made solely for purposes of describing the functionality of the Service.

15. Indemnification

You will defend, indemnify, and hold harmless AppraisalAPI, its owner, operators, affiliates, contractors, service providers, successors, and assigns from and against any claims, demands, actions, investigations, liabilities, damages, losses, judgments, settlements, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

  • your Submissions;
  • your use of the Service;
  • your breach of these Terms;
  • your violation of law; or
  • any claim that a Submission, or our processing of it as authorized by you, infringes, misappropriates, or violates any intellectual property, confidentiality, privacy, contract, license, or other right of a third party.

This includes any claim by a lender, borrower, appraiser, broker, investor, regulator, data provider, or other third party arising from your Submission, your use of Output, or your failure to independently verify Output.

16. Disclaimers

THE SERVICE IS PROVIDED FREE OF CHARGE, AS A COURTESY, ON AN "AS IS," "AS AVAILABLE," "WITH ALL FAULTS," AND "BETA/EXPERIMENTAL" BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, PERFORMANCE, SECURITY, AVAILABILITY, OR THAT OUTPUT WILL BE ERROR-FREE OR SUITABLE FOR ANY PARTICULAR USE.

WE DO NOT WARRANT THAT THE SERVICE OR OUTPUT WILL SATISFY ANY LENDING, UNDERWRITING, REGULATORY, AUDIT, INVESTMENT, VALUATION, REPORTING, OR COMPLIANCE REQUIREMENT.

AppraisalAPI is a free AI-assisted convenience tool. Output may contain errors, omissions, misclassifications, formatting issues, or other inaccuracies and must be independently reviewed and verified before any lending, underwriting, valuation, legal, regulatory, compliance, reporting, or business use. You may not rely on Output as the sole basis for any decision or action. To the maximum extent permitted by law, AppraisalAPI disclaims all responsibility and liability for any decisions made, losses incurred, or claims arising from use of or reliance on the Service or Output.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, OPPORTUNITY, GOODWILL, DATA, EXPECTED SAVINGS, OR USE, ARISING OUT OF OR RELATING TO THE SERVICE, OUTPUT, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WE WILL NOT BE LIABLE FOR ANY CLAIM ARISING FROM OR RELATING TO: (A) ANY DECISION MADE OR ACTION TAKEN IN RELIANCE ON THE SERVICE OR OUTPUT; (B) ANY FAILURE TO VERIFY OUTPUT; (C) ANY LENDING, UNDERWRITING, INVESTMENT, VALUATION, COMPLIANCE, AUDIT, REPORTING, OR REGULATORY USE OF OUTPUT; OR (D) ANY INTERRUPTION, DELAY, BUG, ERROR, OMISSION, OR INACCURACY IN THE SERVICE OR OUTPUT.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE, OUTPUT, OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100) OR (B) THE TOTAL AMOUNT PAID BY YOU TO US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you to the extent prohibited by law.

18. Arbitration; Class Action Waiver

Please read this section carefully.

To the maximum extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, except that either party may bring an individual claim in small claims court if it qualifies.

You and AppraisalAPI each waive:

  • any right to a jury trial; and
  • any right to participate in a class action, collective action, coordinated action, mass action, private attorney general action, or representative proceeding.

The arbitration will be conducted in Dallas County, Texas, in English, before a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction.

If this arbitration section is found unenforceable as to a particular claim, then that claim must be brought exclusively in the state or federal courts located in Dallas County, Texas, and the parties consent to personal jurisdiction and venue there.

19. Governing Law

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Texas, without regard to conflict-of-laws rules.

20. Changes to the Service or Terms

We may modify the Service or these Terms at any time. Updated Terms become effective when posted. Your continued use of the Service after updated Terms are posted constitutes your acceptance of the updated Terms.

21. Assignment and Business Transfer

We may assign or transfer these Terms, and any of our rights or obligations under them, in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our business or assets.

You may not assign these Terms without our prior written consent.

22. Miscellaneous

These Terms constitute the entire agreement between you and us regarding the Service and supersede prior or contemporaneous understandings relating to the Service.

If any provision is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any provision is not a waiver.

Any provision that by its nature should survive termination will survive, including provisions relating to licenses, disclaimers, indemnity, limitations of liability, dispute resolution, and data rights.
